Unprecedented
It was not even thinkable, let alone doable. A court convicting a military dictator of subverting the Constitution and sentencing him to death is something that hardly anybody in the country could have ever imagined possible. But a special court proved “howsoever high you may be; the law is above you”. The three-judge court, in a split 2-1 decision, declared former army chief Pervez Musharraf guilty of high treason and handed him the death sentence in what is indeed a historic, momentous and groundbreaking decision – even if it remains unimplemented and only carries a symbolic value. The court established the principle that no individual, group or institution is more powerful than the law, and that the Constitution reigns supreme, whatever the circumstances. The judgment is extraordinary given the way the judiciary has conducted itself in the past. It is earth-shaking by the standards that we have set and the principles that we have followed thus far. A great deterrence against unconstitutional acts, the judgment serves a loud and clear message to any future adventurers that there can be no compromise on civilian supremacy in judicial dispensation.
While the judgment is generally welcome as a transformational moment in the country’s history, for quite too many – including renowned judicial experts – the court has only delivered selective justice by limiting the scope of the trial to just one person and letting his aiders and abettors go scot-free. The argument goes that Musharraf’s real sin was to topple a democratic government, on October 12, 1999, and hold the Constitution in abeyance. However, Nawaz Sharif, as prime minister, invoked Article 6 of the Constitution against Musharraf for the declaration of the state of emergency on November 3, 2007 and deliberately ignored what was really incriminating i.e. the October 12, 1999 military takeover. Many an expert also believes that while the October 12 takeover was indeed a treasonous act, the November 3 declaration of emergency was not. And then there is this argument too that the fair-trial condition remained unfulfilled in a trial as serious and sensitive as high treason, as Musharraf was not given a proper opportunity to defend himself.
The judgment did not either go down well with the military which believes “the due legal process seems to have been ignored including constitution of special court, denial of fundamental right of self-defence, undertaking individual specific proceedings and concluding the case in haste”. The special court decision “has been received with [a] lot of pain and anguish by rank and file of Pakistan Armed Forces”, says a spokesperson for the Pakistan Army, making it clear that “an ex-Army Chief, Chairman Joint Chief of Staff Committee and President of Pakistan, who has served the country for over 40 years, fought wars for the defense of the country can surely never be a traitor”. The armed forces “expect that justice will be dispensed in line with Constitution of Islamic Republic of Pakistan”.
Doubts, thus, persist over the implementation of the decision, even though the legal process will still continue as the APML, the political party that Musharraf heads, has already announced that the verdict will be challenged in the Supreme Court. The judgment, meanwhile, is bound to breed conflict – between the institutions, and within the political class. While the top court will conceivably come under pressure given the “pain and anguish” felt by the soldiers, the political opposition will latch on to the golden opportunity to call the government’s bluff on their much-trumpeted mission of ensuring justice and equality in the country in line with the principles of Riyasat-e-Madina.
Gender parity and Pakistan
Pakistan is placed at 151 out of 153 countries on the Global Gender Gap Index Report 2020, only above Iraq and Yemen. The report published by the World Economic Forum recently ranks Pakistan 150 in economic participation and opportunity, 143 in educational attainment, 149 in health and survival and 93 in political empowerment. The overall ranking for Pakistan has drastically slipped from 112 in 2006 to 151 in 2020.
On all counts the country has shown a declining trend. Over the same period, in economic participation and opportunity, Pakistan has slipped from 112 to 150, from 110 to 143 in educational attainment, from 112 to 149 in health and survival and from 37 to 93 in political empowerment. The report says economic opportunities for women in Pakistan are limited with the country only managing to bridge 32.7% of the gap between men and women in the workplace. In health and survival, the gap has widened to 94.6%, which means women do not have the same access to healthcare as men.
Among the seven South Asian countries included in the index, Pakistan occupies the last position. Bangladesh has ranked 50, followed by Nepal 101, Sri Lanka 102, India 112, the Maldives 123, and Bhutan 131. The region has closed two-thirds of its gender gap. In the region, female population is 860 million. Among the eight regions of the world, South Asia’s gender gap is the second-largest after the Middle East and North Africa region, where only 61% of the gender gap has been closed.
Pakistan’s declining position on the gender parity index is an indictment of both its government and society. Bangladesh has left India, known as the second-fastest growing economy of the world, far behind in the gender parity index. With life expectancy at 72.49 years, and literacy rate at 72.8% (female 70.09%, male 75.7%), it is doing better than India in child immunisation and birth control.
